JOB TITLE: Assistant Vice President Commercial (Interborough Express) AGENCY: Construction & Development DEPT/DIV: Delivery/ Interborough Express REPORTS TO: Senior Vice President, Project Executive WORK LOCATION: 2 Broadway HOURS OF WORK: 9:00 AM to 5:30 AM or as required (7.5HR/ DAY) HAY POINTS: 1262 SALARY RANGE: 144,634 to 1 89,832 DEADLINE: Open Until Filled S ummary The Interborough Express would provide a transformative new transit connection between Brooklyn and Queens - providing a direct rail link between Bay Ridge and Jackson Heights in less than forty minutes - with service projected every 5 minutes during the peak. Nineteen (19) stations are planned over an existing 14 - mile rail corridor. The stations will allow for connections up to 17 subway lines and 50 bus routes. The AVP, Commercial Executive, reporting to the Vice President, Deputy Project Executive (Commercial), is responsible for managing capital project delivery working on the Interborough Express project in the MTA Construction and Development (C&D) Delivery Department. This position is responsible for project management activities that ensure project delivery is safe, efficient, on schedule, within budget, and per project documents, contractual requirements, and relevant policies, procedures, standards, and guidelines. The AVP Commercial Executive will assist the Vice President, Deputy Project Executive (Commercial) in overseeing the commercial aspects of all Interborough Express-related contracts and contract procurement , including design, consulting, project management, construction, acquisition, and use / operating contracts. This will include the scope of work definition, contract negotiations, amendments, change orders, claim/dispute resolution, compliance, payment, closings , and close-outs. The AVP, Commercial Executive will assist in managing commercial matters for the entire lifecycle of the project (planning phase through operations) and in ensuring compliance with budget and schedule expectations across all contracts , including developing and using monitoring/projection tools . The AVP, Commercial Executive will assist the Vice President, Deputy Project Executive (Commercial), in serving as overall project manager for the Interborough Express – identifying the critical path and key decisions required to keep progressing the project across many disciplines: contract procurement, environmental review, project financing, entitlements, regulatory approvals, acquisitions, design development, and construction. Additionally, the AVP, Commercial Executive, will assist with stakeholder management of City and State agencies and third - party operators and will help with community and elected outreach activities. Furthermore , the AVP, Commercial Executive, monitors project status, mitigates risk, and resolves project issues, consulting with and providing recommendations to senior management for critical issue resolution. This position coordinates project delivery activities with C&D and third - party operators and partners and manages staff, contractors, consultants, and agency forces in the safe and efficient execution of capital projects. Responsibilities Experienced commercial manager, assisting the Vice President Deputy Project Executive (Commercial) in managing all aspects of commercial matters (contract negotiations, processing invoices, change order negotiations, cost estimating, claim/dispute resolution, and diversity compliance). Negotiate contracts , including Design-Build (D-B) contract Best And Final Offers (BAFO), Project Management/Construction Management (PM/CM) contracts, third - party railroad and pipeline agreements, agreements with City and State agencies and authorities, and use and operating agreements. Coordinate project activities with the project team, C&D staff, contractors, consultants, third - party operators and partners, and other stakeholders. Coordinate with third - party operators and partners to ensure that necessary actions, approvals, and resources are in place to support project delivery. Develop, monitor, and evaluate cash flow reports and provide cost projections and estimates. Evaluate requests for contract change orders and amendments. Negotiate and draft change order s and amendment language. Identify cost and schedule impacts of all contract changes. Validate the merit of all claims and disputes against the contract documents and negotiate resolutions. Monitor D-Ber and PM/CM compliance with diversity requirements. Engage with firms to ensure good faith efforts are made. Education and Experience A Bachelor’s degree in Engineering, Architecture, Construction Management, Business Administration, or a related field . Masters Degree preferred. Must have a m inimum of 1 4 years experience in Engineering, Architecture, Construction Management, Business Administration, contract management, or a related field . Must have a minimum of eight (8) years in a management or supervisory role and/or project/commercial manager role in a large, multi-faceted organization. Experience in the construction or transportation industries is highly preferred. In-depth knowledge of transportation and construction industries and MTA agency policies and procedures is preferred. Must know various consultant professional and construction contractual agreements, Federal Acquisition Regulations, and general procurement principles. Experience with MTA procurement principles and large capital project management procurement preferred. Knowledge of project management control systems and business workflow development is desirable. Experience in database workflows and implementation of project management systems preferred. Substantial experience leading and managing contractors, subcontractors, or vendors. Proven ability to collaborate with a broad range of stakeholders and drive outcomes. Must be a proven leader as a change agent and creative/innovative thinker with the ability to align business goals with solutions to drive process improvements. Must have focus and ability to deliver on results, organizational effectiveness, development, and continuous improvement. Must possess proven leadership ability, sound judgment, effective oral and written communication skills, and the ability to resolve conflicts and balance competing priorities. Must possess excellent team - building , listening, problem - solving, and prioritization skills. Proficient computer skills (i.e., Windows environment, Microsoft Office, Primavera, etc.) and strong business administrative skills (i.e. , presentations, report and letter writing, time management, etc.).
