For the duration of the NY HELPS Program, this title maybe filled via a non-competitive appointment, which means no examination is required but all candidates must meet the minimum qualifications of the title for which they apply. At this time, agencies may recruit and hire employees by making temporary appointments. In May 2024, if a temporary NY HELPS employee is satisfactorily performing in the position, the appointment will be changed from temporary pending Civil Service Commission Action to permanent non-competitive and the official probationary period will begin. At a future date (within one year of permanent appointment), it is expected employees hired under NY HELPS will have their non-competitive employment status converted to competitive status, without having to compete in an examination. Employees will then be afforded with all of the same rights and privileges of competitive class employees of New York State. While serving permanently in a NY HELPS title, employees may take part in any promotion examination for which they are qualified.NON-COMPETITIVE MINIMUM QUALIFICATIONS: To be considered for appointment through NY HELPS, or 55 b/c, candidates must meet the open-competitive minimum qualifications for this position. The OSR is responsible for reviewing the decisions of impartial hearing officers concerning the identification, evaluation, program, or placement of children who have, or are suspected of having, an educational disability. Duties of these positions include, but are not limited to, the following: Maintain an expertise in special education law, legal research, and legal writing; Analyze the facts and laws in each appeal in light of the extensive procedural and substantive provisions of federal and State law relating to children with disabilities; Prepare written draft decisions which accurately identify the factual and legal issues to be determined, and make recommendations in a clear, concise, and logical manner; Manage assignments to ensure timely completion of quality decisions; and Work collaboratively and effectively with other staff. Additional Comments CONDITIONS OF EMPLOYMENT: This will be a contingent permanent, competitive appointment or a contingent permanent non-competitive appointment. Continued employment as a Senior Attorney, SG-25 is dependent upon maintaining admission to the New York State Bar. Failure to maintain admission to the New York State Bar will result in removal from employment from applicable titles. This position may be filled as a traineeship. The starting salaries for this position are outlined below. For current New York State employees, salary is based on the candidate’s salary at the time of hire.
