Synopsis:
Looking for legal help to fight a Circuits court lawsuit against a small company (that wants to teach me a lesson to stay away from their name. Facts: They used a DBA with the city name, followed by the profession. I used the city name, followed by the profession AND Inspection (they did not have inspection in their name, until they filed another DBA that I was using). On Sunbiz I can find hundreds of names that differ just by one word, or letter…. Additionally, I wasn’t using the name of the Website to deposit checks, I used a similar company I’ve had for 6-7 years. Everything is 100% legit from my side, except that I haven’t deposited checks in the name I advertised. However, customers write the checks, NOT me, so it’s not like I deceived them when I ask them to write the checks. Oh, and not a single customer complaint (5-star reviews only, except from [a non-customer] saying something like: Stay away from this company, their website isn’t legit. I suspect it was them.
My problem:
I don’t have the financial means to fight them. I e-filed a response on behalf of my company and myself (they included both in the suit) before the 20 days asking for more time to find an attorney, another 6 days has passed. They have now filed a motion to default. I prepared a motion to dismiss, but I don’t know the accuracy of it.
What I have:
I only have $5000, no assets beside two cheap cars and a few old AOB’s I can throw in. Yes, I have credit card depts and more. I can’t start fighting alongside an attorney and they asking for more money I don’t have. So, I’m scared to give away the $5000 I have without the case finishing.
What I can give:
If you are an attorney that knows how to fight these guys, I’m happy to give you the money, but you have to promise to finish. If we are still fighting a year from now, I hope to have made some more money….that I can pay you, but I can’t cash you $350/ hour, or more that you probably are worth. I have some old AOB that I have left from the time that it had fee provisions to attorneys that I can give you as a bonus.
