Description of JobThe salary range for this position is:$43.88 - $64.47 Hourly $3,510.46 - $5,157.69 Biweekly $7,606.00 - $11,175.00 Monthly $91,272.00 - $134,100.00 Annually The Industrial Claim Appeals Office (ICAO) is an administrative appellate court. It is the only appellate body within the Colo. Dept. of Labor and Employment. Unlike trial courts, who hear cases for the first time, appellate judges do not try cases and rarely review new evidence. Appellate judges are concerned with making sure that the trial judges and hearing officers correctly interpreted and applied the law to the facts of the case in front of them. The General Assembly in § 8-1-102 passed enacting legislation for the ICAO which consists of five examiners. Decisions and orders may be made by two appeals examiners. The Panel has the duty and the power to conduct administrative appellate review of any decision or order entered pursuant to the Colorado Employment Security Act (UI) and the Colorado Workers’ Compensation Act (WC). This position reviews appeals of administrative law judges or director decisions in workers’ compensation matters and hearing officer decisions in unemployment insurance cases, and issues orders that constitute final agency action. That work requires:

Exercising independent legal judgment in the complex systems that are Workers’ Compensation and Unemployment law.

Reviewing the record of WC hearings and UI hearings which includes review of the transcript of hearings; legal research into the specific issues involved.

Draft a proposed order with recitation of the established facts, conclusions of law, and order of resolution.

Collaborate with the assigned co-author to discuss the proposed order and attempt to resolve any disagreement with the outcome or reasoning underlying the order.

Act as a co-author and review the proposed order drafted by the primary author, also with full collaboration.

Enter a final decision whether to affirm, set aside and remand, or reverse the underlying ALJ’s or Hearing Officer’s decision.

Reconsider orders based on proper additional information.

Present finalized orders to the staff for distribution and publication, as required.

Train and mentor junior staff (paraprofessionals and hearing officers at UI).

Previous experience performing similar duties as a State of Colorado classified employee.
