Flexible hours but you would work 30 hours or so. You would start as a 1099 independent contractor. And while you might prefer to remain at 1099 and that might be possible you are no doubt familiar with California's statutory framework regarding classification of independent contractors and employees (the ABC test) and would eventually almost by necessity become a W2 employee within a year or so.

Requirements:

2 years of experience in either California civil litigation or California family law.

You must provide 4 examples of motions you have prepared:

Acceptable Motions:

1. Motions to Compel Further Responses to Requests for Production (including separate statement)

2. Family Law Requests for Orders Motions (including appropriate judicial council forms such as FL-300, declaration in support and income and expense)

3. Motions for summary judgment

4. Anti-SLAPP

5. You need to know how to electronically file documents. You need to have experience working with a vendor uploading and filing pleadings in Los Angeles and Orange counties.

6. Ability to confirm case law. If you're the licensed California attorney for about 100 bucks you can join the California lawyers association and then you get a free fast case membership which is a very very very poor second to something like westlaw but it's enough to shepardize cases. As a law and motion attorney you’re responsible for confirming the cases and statutes upon which you rely.

7. Experience in Bankruptcy, Immigration is NOT what you need. You need California Civil Litigation or California Family Law Litigation experience.

Very Awesome Things That Are Not Requirements:

a. Familiarity with mycase or clio as the practice management software you would use to calendar, obtain tasks, store data, etc.

b. Familiarity with clio draft (formerly lawyaw) the Forms Production software. All family law pleadings require a Judicial Council Pleading to which one adds data as pdf attachments.

About the job:

I mostly do family law and criminal cases. I have a few business litigation cases. I'm a member of the federal bar. I've tried numerous cases in the federal courts. Most of your law in motion would be family law requests for orders regarding custody and support. You'd also complete the income and expense declaration that is almost a prerequisite for family law motions. You'd also do motions to compel when no responses are received to discovery which are super simple and you do motions to compel when responses are received and are inadequate which motions are super freaking labor intensive as you have to have a separate statement.

You'd have secretarial support so most of your pleadings would actually get filed by a secretary but sometimes you get them done late at night you must file them yourself.

You would necessarily have some telephonic, e-mail, text communications with clients.

If you want to go to court you can, if you don't want to you don't have to.
