SummaryThis position is in the Adjudication Group, which advises and assists the Commission in issuing published opinions in contested appeals from the decisions of administrative law judges, self-regulatory organizations, and the Public Company Accounting Oversight Board, as well as in contested administrative proceedings set for a hearing before the Commission.ResponsibilitiesServe as a Senior Adjudication Counsel within the Adjudication Group of the Office of the General Counsel.Provide counsel with respect to contested appeals from the decisions of ALJs, self-regulatory organizations and the Public Company Accounting Oversight Board, as well as contested administrative proceedings set for a hearing before the Commission.Communicate with the Commission on matters that are of the highest level of complexity, involve precedent-setting legal issues, and have a significant impact on the administration of the securities laws.Advise the Deputy General Counsel with respect to the proper resolution of these matters.Work with the Associate General Counsel for Adjudication directly on certain matters.Confer with the operating divisions and offices with respect to matters within their expertise.Assist the Appellate group with appeals from Commission opinions.Prepare draft opinions in the most complex adjudications before the Commission.Review and edit first drafts of opinions prepared by other attorneys.Review the record, the parties' briefs, and the relevant precedent.Draft orders in response to motions in unassigned matters.RequirementsConditions of EmploymentQualificationsAll qualification requirements, including time-in-grade, must be met by the closing date of this announcement. Qualifying experience may be obtained in the private or public sector. Volunteer work helps build critical competencies, knowledge, and skills and can provide valuable training and experience that translates directly to paid employment. You will receive credit for all qualifying experience, including volunteer experience. Qualifying education must have been obtained from an accredited college or university recognized by the U.S. Department of Education. BASIC REQUIREMENT: All applicants must possess the following J.D. or LL.B. degree AND Active membership of the bar in good standing in any state, territory of the United States, the District of Columbia, or the commonwealth of Puerto Rico. (Note: proof of bar membership will be required before entry on duty. MINIMUM QUALIFICATION REQUIREMENT: In addition to meeting the basic requirement, applicants must also meet the minimum qualification requirement.SK-16: Applicant must have one year of specialized experience equivalent to the GS/SK-14 or SK-15 level. Specialized experience includes: Interpreting the Administrative Procedure Act and the seminal cases governing administrative proceedings in federal administrative agencies; Interpreting and applying federal securities laws, the rules and regulations thereunder, and the use of administrative proceedings to enforce those laws, rules, and regulations; Reviewing the disciplinary proceedings of the self-regulatory organizations and the Public Company Accounting Oversight Board.EducationFOREIGN EDUCATION: If you are using education completed in foreign colleges or universities to meet the qualification requirements, you must show the education credentials have been evaluated by a private organization that specializes in interpretation of foreign education programs and such education has been deemed equivalent to that gained in an accredited U.S. education program; or full credit has been given for the courses at a U.S. accredited college or university.
